[1]               David Melding: Good afternoon and welcome to this meeting of the Constitutional and Legislative Affairs Committee. I will start with the usual housekeeping announcements. We do not expect a routine fire drill, so, if we hear the fire alarm sound, please follow the instructions of the ushers, who will help us to leave the building safely. Please switch off all electronic equipment completely, as otherwise, even on silent, it will interfere with the broadcasting equipment. These proceedings will be conducted in Welsh and English. When Welsh is spoken, there is a translation on channel 1 and channel 0 will amplify our proceedings. We have apologies from Julie James, and I welcome Mark Drakeford as her substitute this afternoon.

[3]               David Melding: There is a paper to note on our subsidiarity monitoring and the report for the 2012 autumn term, from September to December. Are there any comments or issues that we want to explore arising out of the report?

 

[4]               I have one, actually. I have been lobbied by a couple of people on the tobacco regulation directive, which may have an impact on e-cigarettes. I do not know whether there is anything that we can do or whether it would relate to a subsidiarity issue rather than an issue that the UK Government would take on. It is about selling, prescribing or whatever the devices that some people use to get a dose of nicotine rather than using patches—obviously it simulates the action of smoking more directly. This has been raised with me by a couple of members of the public that they find them useful and that they are concerned that this may restrict their ability to get these products, so perhaps I could ask the secretariat to find out a bit more information on this and whether there is anything that we could relay. We will do that. Is there anything else on the monitoring report? I see that you are content. I think it is useful and helpfully laid out.

the committee resolves to exclude the public from the remainder of the meeting in accordance with Standing Order No. 17.42(ix).
